You Be The Judge: Innocent Or Guilty

Crime - Voluntary Manslaughter, Aggravated Assault
Victim - U.S. Marine Corps Sgt. Jack R. Snook
Justice - Three years ago on April 3,2005 Marine Jack Snook and college student Charles Key meet on an Atlanta road (Linden Avenue). They both lived different lives and were well respected among their family and friends. One was a returning war veteran and the other was a young college student with a promising future. In one moment of fright or flight, Jack Snook would die from a gun shot wound to the face and Charles Key would be arrested for his murder.

According to witnesses that were in the car with Jack Snook (all who admitted to drinking that night), testified Wednesday (August 13) that Snook was shot by Keys out of an act of road rage. Jessica Handley testified that she remembered Snook getting shot and saying, "I am OK.", but could not remember other details of that night. During cross examination, she could not respond to whether or not racial slurs had been directed towards Charles Key that night.

In an October 2005 Creative Loafing interview given by Cara Snook (victim's spouse), her accounts of what happened are:
-After drinking that night (August 2, 2005), they (her, Jack, Dennis Canfield, and two of her girlfriends) drove in Canfield's car on the way to a downtown Atlanta hotel.
-They got lost and missed their exit off I-75/85.
-They turned around and took the exit for Spring Street and West Peachtree.
- They stopped on Linden Avenue at the traffic light (arguing about the directions).
-When the light turned green, the truck behind them was honking the horn.
-As they drove further up, the driver in the truck was still close behind honking the horn.
-The driver of the truck swerved into the turning lane on the left side of Canfield's car.
-The driver of the truck leaned across his seat and opened the passenger door and called them "b***"
-The driver of the truck looked at Jack and said, """C'mon b***, c'mon!"
-Jack (enraged) jumped out of the car and ran towards the truck.
- A friend (Jessica Handley) tried to restrain Jack but could not
-Jack pulled the truck's passenger door opened wider (left opened by driver earlier).

-Cara got out of the car as Jack was opening the door.
-Cara heard a gun shot and saw smoke coming from the cab of the truck
-The truck drove off as Jack stumbled back.
-Jack said, ""I'm OK. I'm OK."
-She saw that Jack had been shot in the face.
-Jack started coughing blood, said "I love you so much", squeezed her hand, and died in her arms.


According to the same Creative Loafing 2005 interview, Charles Anthony Key makes the following accounts of events that happened that night:
-After having car trouble, he borrowed his parents truck to go and visit his girlfriend.
-The low fuel light came on and he exited the highway to buy gas.
-He moved in the exit lane and had to hit on the brakes because the car in front was driving slow.
-He leaned over to change the CD and accidentally hit the horn.
-The passengers in the car in front flipped him off.
-"I will kill you, mother***!", a man in the passenger seat yelled out.
-Key pulled up on the left side of the car at the next traffic light.
-The people in the car honked the horn again.
-The man that had been yelling at him (Key) got out of the car and came up to Key's passenger door.
- "I will kill you!", the man yelled.
-One of the girls tried to hold the man.
-The man pushed her away and opened Key's passenger door.
-Key, afraid for his life, reached for his registered gun and shot the man.
-The man fell.

Charles Anthony Key also make reports that racial slurs were yelled at him. During Wednesday testimony under cross examination, Jessica Handley (a passenger in the car with Jack Snook) testified that she remembered Snook getting shot but could not recall any one yelling racial slurs. Jessica was the friend that tried to hold Jack back from approaching the truck that Charles was driving. On another note, there is a witness that Dennis Scheib (Key's attorney) says heard the racial slurs from the car Jack Snook was in. All the witnesses in the car, admitted to drinking that night but no drug test was done to determined if their accounts are credible.

Friends described Jack Snook as a man who was not afraid of anything. Marine Snook had just return from Iraq and was living apart from his wife. Cara Snook (Jack's widow) said in a 2005 interview that Jack had left the Marines, "but the Marines had not left him." Friends also described Jack as a 6" tall man that would look a stranger up and down.

During Jack Snook's Iraq tour, Jack and his fellow company were called the "Suicide Squad." Their job was to protect the convoy and draw out the enemy. Cara Snook spoke in the Creative Loafing 2005 interview about nights when her husband would start talking about his time in Iraq and cry about it. After days of moving into a North Carolina apartment together, Jack Snook moved back to Cumming (Georgia) and lived with his parents. Jack's Marine career was over and his marriage was in Jeopardy.

Jack and Cara were working out their problems and had reconciled on April 2. What seemed like a night to a new beginning later ended with a night that Cara will never forget. On the early morning of April 3, 2005, Jack Snook died in Cara's arm.

The question we will be waiting for an Atlanta jury of 12 to decide for both Charles Anthony Key and the family of the late Jack Snook is, "Was it self defense or manslaughter?"

My 2 Cents: i went to high school went charles key, i didn't know him like that but i never heard bout him being a nigga that start shit. i personally think he shouldn't be convicted of manslaughter for the simple fact the marine got out of his car and came towards his. words were already exchanged so the marine wasn't coming to his car to talk. he was looking for trouble and sad to say he got more than what he was looking for. thats just my honest opinion whats yalls?
